Who Gets The Kids?
In the area of divorce law, there are many factors a court will consider in determining who will get the kids. The standard of using the best interests of the child is a good rule of thumb, but of course how this is spelled out to the court that makes such a decision can depend on how good the divorce attorneys are for both sides. Generally, a court will attempt to make sure that the child remains in both parents' lives, but of course a wide variety of factors help influence exactly how this plays out.
Traditionally, the mother had a far better chance of getting physical custody, and while this has softened over the years, there is still much truth to this notion. Of course, many things can influence a court on the matter of who gets the kids, from the most basic (drug or alcohol abuse, an unfit household) to more complex (where will the child get a better education, which household will be least disruptive to the child).
Often times, the couple themselves will be able to map out a rough idea of how custody should be arranged, with joint custody and visitation rights for both spouses. However, especially when these points are dramatically contested, the skills of a qualified divorce attorney are essential.
