DUI Laws

Driving under the influence (DUI) or driving while intoxicated (DWI) laws can be very tricky, especially as what exactly is and is not a legal offense tends to hinge on very specific things. Each year, over 1.5 million Americans will be charged with a DUI or DWI crime, but of course countless more people will have a drink or two and get behind the wheel. The key words in understanding DUI laws are "impaired driving."

Impaired driving (driving when your ability is affected by alcohol or drugs) is sometimes defined as driving with an unlawful blood alcohol level, although with prohibited drugs, any amount is considered unlawful under the scope of DWI laws. It is not against the law to drink and drive by itself, but when the amount of alcohol reaches a certain percentage or higher, then the various laws pertaining to DUI can come into effect.

Of course, common sense tells us that if you've been drinking at all, perhaps it's better not to be driving. Then again, if you're reading this right now, you likely have been involved with a DUI situation, and "common sense" is now besides the point - it's time to educate yourself on DUI laws to protect your rights or the rights of a loved one.

One very important thing to keep in mind - no matter your age, your driving history or your so-called alcohol tolerance, you are ultimately not the one who makes the decision whether you should be able to be driving or not. For example, you may say you have a very high tolerance for alcohol, and might even seem perfectly sober. However, if you have a blood alcohol amount above the legal levels, your apparent "tolerance" is no defense under the DUI laws.
