Divorce Alternatives
Besides the actual divorce, there are two main kinds of separations that a divorce attorney may be of assistance with for couples who do not want to continue their relationship as is. The most common of these is a legal separation, where the couple makes a permanent decision to separate without actually getting a divorce. Unlike a trial separation, which couples can do on their own and which doesn't really need to have a divorce lawyer involved, a legal separation can involve issues like alimony, child support and division of assets.
Another divorce alternative is annulment, which roughly means that there never was an actual marriage at all. In cases involving deception, such as being underage, having another spouse or even sometimes matters like drug abuse or the ability to have children, a court may grant an annulment.
In the case of either legal separation or annulment, a divorce attorney is needed in order to help their client wade through the many turbulent matters that are a by-product of separating from a spouse. Ultimately though, the ideal divorce alternative may simply be a cooling off period, including counseling, so that the couple may in time come to realize that they do not wish to be apart at all.
