Child Custody
Even more so than with financial matters, if there are children involved, the divorce lawyer's most important job may be in sorting out the matter of custody. The court will ultimately use a standard roughly defined as "what is in the best interests of the child" in awarding custody, but often how this is presented to the court by the divorce attorney can make a world of difference.
There are four main terms you will encounter when dealing with custody in divorce law. Physical custody states who the child (or children) live with after a divorce, while legal custody covers which spouse is responsible for making decisions on the child's religion, health, education and other important decisions.
Beyond physical and legal custody in the world of divorce law, there are the broader terms of sole custody and joint custody. Sole custody means that one spouse has legal and physical custody, with the other spouse usually having visitation rights. Joint custody means both spouses have legal custody (and sometimes physical custody), with much more broadly defined visitation rights.
