Blood Alchohol Levels

The biggest factor in determining both the severity of the charge and the possible punishment in a DUI case is often related to the arrested person's blood alcohol content. Blood alcohol content is the estimated percentage of alcohol in the blood, and can normally be determined before the fact by the number of drinks in relation to body weight. To that end, knowing how much you can drink before driving is absolutely essential for the smart driver. A good rule of thumb though - when in doubt, don't drive.

Though legal limits vary considerably state by state, a blood alcohol content of greater than .080 is in most states considered legally intoxicated, while a blood alcohol content of less than .050 is considered not impaired in most states. The difference between legally intoxicated and legally impaired is one of degree, as set forth by the state's DUI laws.

There are many charts one can look at in advance to determine how much is safe to drink before driving. In very rough terms, an average weight male can have roughly one drink per hour, with a "drink" considered 1 ¼ oz. of 80 proof alcohol, 4 ounces of wine or 12 ounces of beer. Of course, these definitions should not be taken as absolutes, as some beers are much stronger than others, some alcohol is over 80 proof or a glass of wine may be more than four ounces. Also, some people simply break alcohol down differently, and the amount of time you consume the alcohol in is a big factor in how much remains in your system. As there are so many variables involved, a big word of caution is definitely in order. If you know you are going to be drinking at all, it is always smarter to look into other possibilities besides your own driving.
